Axiomtek KIWI310 Sweepstakes – Terms and Conditions 

  1. Eligibility: The Axiomtek KIWI310 Sweepstakes (the "Sweepstakes") is open to legal residents of the United States of America, including all states and territories, who submit an entry at the 2024 embedded world North America exhibition & conference held in Austin, Texas, or a digital entry during the Sweepstakes Entry Period. No purchase is necessary to enter or win. Entrants must be 18 years of age or older as of their date of entry to qualify. This Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law. Employees of Axiom Technology, Inc. USA ("Axiomtek"), its subsidiaries, affiliates, suppliers, partners, advertising and promotion agencies, and directors (collectively the “Employees”), along with members of an Employee's immediate family and/or household, are ineligible to participate in the Axiomtek KIWI310 Sweepstakes. The Sweepstakes is not affiliated with Embedded World North America. 

  1. Sponsorship. The Sweepstakes is sponsored by Axiom Technology, Inc. USA ("Sponsor"), located at 18138 Rowland St., City of Industry, CA 91748. The Sponsor will conduct the Sweepstakes as described in these Official Rules.  

  1. Agreement to Rules: By entering this Sweepstakes, you (“Entrant”) agree to abide by the Sponsor's Official Rules and decisions, which are fully and legally binding in all respects. The Sponsor reserves the right to disqualify any entry at its sole discretion. By entering, you represent and warrant that you meet the eligibility requirements set forth herein. You also agree to accept the Sponsor's decisions regarding the Sweepstakes as final and binding. 

  1. Axiomtek KIWI310 Sweepstakes Entry Period: The Sweepstakes begins on October 1, 2024, at 12:00 AM Pacific Time and ends on October 31, 2024, at 11:59 PM Pacific Time (“Entry Period”). All entries must be received within this period to be eligible.  

  1. How to Enter: To enter the Axiomtek KIWI310 Sweepstakes, eligible entrants must submit their contact information (such as via a business card or completed form) during the 2024 embedded world North America exhibition & conference in Austin, Texas. Alternatively, participants may also enter by submitting their contact information via email to info@axiomtek.com, subject to approval. Entries must include accurate and up-to-date contact information; only one entry per person is permitted. Incomplete or fraudulent entries will be disqualified at the Sponsor's sole discretion. 

  1. Prizes: Up to five (5) winners will each receive a KIWI310 Embedded Board/SBC with an approximate retail value worth of up to $380. The actual value may differ at the time of the prize award. No cash or other prize substitutions will be offered, and the prize is non-transferable. Axiomtek is not liable for any issues regarding the use, condition, or functionality of the product upon receipt, and no replacement prizes will be issued. The winner, upon acceptance of the prize, is solely responsible for all expenses related to the prize, including without limitation any and all local, state, and federal taxes. By accepting the prize, the winner grants permission for Axiomtek to use their name and likeness for promotional purposes without further compensation, unless prohibited by law.    

  1. Odds: The total number of eligible entries received determines the odds of winning.  

  1. Selection of Winner, Notification of Winner, and Prize Claim Process: The winner(s) will be selected by a random drawing under the supervision of the Sponsor. Only one winner is permitted per company entering the sweepstakes. If a second winner is drawn who is employed by the same company as a previous winner, the second drawing will be discarded, and an alternate winner will be randomly selected. Winners will be notified via the email address provided with their entry within ten (10) days following the drawing. Axiomtek is not responsible for failed notifications due to incorrect or non-functioning contact information or email filtering. To claim their prize, the winner must respond to the notification email and provide any additional information or documentation required by Axiomtek within fifteen (15) days of the notification date. If a winner does not claim the prize within fifteen (15) days of the email notification, or is found to be ineligible, the prize may be forfeited, and an alternate winner may be selected. Upon verification of eligibility, Axiomtek will ship the prize to the winner’s provided address at no cost to the winner, within sixty (60) days after the prize has been claimed. Axiomtek is not responsible for any delays, damage, or loss of the prize during shipping. Winners may be required to complete and return an affidavit of eligibility and a liability/publicity release, as well as any required tax documentation (e.g., IRS Form W-9 for U.S. residents) before the prize is awarded. Failure to provide these documents may result in prize forfeiture. 
    IF THE WINNER VIOLATES ANY OF THESE OFFICIAL RULES, THE WINNER (AT THE SPONSOR’S SOLE DISCRETION) WILL BE DISQUALIFIED, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.  

  1. Rights Granted by You: By submitting an entry into this Sweepstakes, participants agree to opt-in to receive marketing emails and newsletters from Axiomtek and consent to be contacted for sales and marketing purposes. You understand and agree that the Sponsor, any individual acting on the Sponsor’s behalf, and the licensees successors, and assigns of the Sponsor shall, where permitted by law, have the right to print, publish, broadcast, distribute and use in any media known now or hereafter developed, in perpetuity, worldwide, and without limitation, information you provide, your submission, name, photo, portrait, voice, likeness, image, statements about the Sweepstakes, and your biographical information for news, publicity, advertising, promotional purposes, trade, information, and public relations without any further notice, review, consent, compensation, or remuneration. This does not include sharing sensitive or personal information beyond what is necessary for the promotional use of the Sweepstakes.  

  1. Terms & Conditions: In its sole discretion, the Sponsor reserves the right to modify, suspend, cancel, or terminate the Sweepstakes should non-authorized human intervention, a bug or virus, fraud, or other causes beyond the Sponsor’s control, impact or corrupt the security, fairness, proper conduct, or administration of the Sweepstakes. The Sponsor, in the event of any of the above issues, may determine the Winner based on all eligible entries received prior to and/or after (if appropriate) the action taken by the Sponsor. Individuals who tamper with or attempt to tamper with the operation or entry process of the Sweepstakes or website or violates these Terms & Conditions will be disqualified by the Sponsor in its sole discretion. In its sole discretion, the Sponsor has the right to maintain the integrity of the Sweepstakes, to void votes for any reason, including, but not limited to: [identify any disallowed entry methods that will result in votes/entries being voided; examples: multiple entries from the same user; multiple entries from the same computer beyond the number allowed by the Sweepstakes rules; or the use of bots, macros, scripts, or other technical means for entering. Attempts by any entrant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws. If any such attempt is made, the Sponsor reserves the right to seek damages to the fullest extent permitted by law.  

  1. Limitation of Liability: Your entry into this Sweepstakes constitutes Your agreement to release and hold harmless the Sponsor and its subsidiaries, representatives, affiliates, partners, advertising and promotion agencies, successors, agents, assigns, directors, employees, and officers against and from any and all claims, liability, illness, injury, death, litigation, loss, or damages that may occur, directly or indirectly from participation in the Sweepstakes and/or the 1) Winner accepting, possessing, using, or misusing of any awarded prize or any portion thereof; 2) any type of technical failure; 3) the unavailability or inaccessibility of any transmissions, phone, or Internet service; 4) unauthorized intervention in any part of the entry process or the Promotion; 5) electronic error or human error in the Promotion administration or the processing of entries.  

  1. Disputes: This Sweepstakes is governed by the laws of the State of California, United States, without regard to conflict of law doctrines. By participating, entrants agree that any dispute shall be resolved individually, without resort to class action, and exclusively by the courts located in the State of California. Entrants waive all rights to punitive, incidental, or consequential damages and any claims for attorneys' fees.

Winners List: You may obtain a copy of the Winner’s name(s) or a copy of these Official Rules, by sending your request via mail with a stamped, self-addressed envelope to: Axiomtek Marketing, 18138 Rowland St., City of Industry, CA 91748, United States of America. Requests must be postmarked no later than 120 days after the Sweepstakes Period
